BY ACCESSING ANY PART OF THE WEBSITE, YOU ARE AGREEING TO THE TERMS AND CONDITIONS DESCRIBED BELOW (THESE "TERMS OF SERVICE") AND THE TERMS AND CONDITIONS OF THE DAGNE DOVER PRIVACY POLICY (THE “PRIVACY POLICY”). IF YOU DO NOT AGREE TO ANY OF THESE TERMS, YOU SHOULD NOT USE THE WEBSITE. Transactions on Website

Dagne Dover reserves the right to refuse any order placed on the Website, and may, in its sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include, but are not limited to, orders placed by or under the same customer account or email address, using the same credit card, are associated with the same phone number (if provided), and/or orders that use the same billing and/or shipping address or billing and/or shipping address of third parties known or reasonably suspected by Dagne Dover to be associated with counterfeiting or Return Fraud. In the event Dagne Dover makes a change to or cancels an order, it will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. User Submissions

Content submitted by users of the Web Site for public view is referred to in these Terms of Service as “User Submissions.” For the purposes of these Terms of Service, Product Reviews constitute User Submissions. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. You represent and warrant that your User Submissions consist entirely of material and/or information that is owned by you, including, but not limited to, any text, music, recordings, illustrations, photographic images, and videographic clips. you are not an employee of Dagne Dover nor do you work for an affiliate or agency of Dagne Dover hired by Dagne Dover to promote and/or sell Dagne Dover products;
Dagne Dover's use of the User Submission you upload does not violate the terms of this Agreement and will not cause injury to any person or entity;
your User Submission (or any portion of it) has not been included in nor planned for use in any other advertising or promotional materials, for Dagne Dover or any third party;
you are a resident of the United States;
you are at least eighteen (18) years of age, or at least nineteen (19) if you are from Alabama or Nebraska, or at least twenty-one (21) if you are from Mississippi;
You are not a professional actor hired by Dagne Dover or a third party for the benefit of Dagne Dover and for the purpose of submitting a User Submission;

to remove or refuse to post any User Submission on the Website that it deems, in its sole discretion, to violate the content submission guidelines noted above or any other provision of this Agreement; and
to suspend or terminate your access to the Website as Dagne Dover deems appropriate in the circumstances.

Dagne Dover does not guarantee that you will have any opportunity to edit or delete any User Submission that you have submitted. You acknowledge that you, not Dagne Dover, are responsible for the contents of any User Submission(s). None of the User Submissions that you upload shall be subject to any obligation of confidence on the part of Dagne Dover, its third-party service providers and agents, or their respective directors, officers, and employees.

You retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions, you hereby grant Dagne Dover an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers), and transferable license to use, reproduce, distribute, edit, modify, prepare derivative works of, display, and perform the User Submissions (and any edited or modified versions or derivative works) in any media formats now or hereafter created and through any media channels now or hereafter created. You also hereby grant each user of the Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Web Site and under these Terms of Service. You also hereby grant to Dagne Dover an unrestricted, worldwide, perpetual, irrevocable, fully paid-up, royalty-free, fully sublicensable right to use your name, nickname, user name, biographical information, vocal recordings of you, and/or any illustrations, photographic or videographic clips, portraits, likenesses or pictures of you or any other indicia of your right of publicity rights (collectively "Your Personal Content") as contained in your User Submission(s), in composite or distorted form or as otherwise incorporated into other creative works of authorship, in any media, format or technology, whether now known or hereafter discovered, and in any manner including, but not limited to, all promotional, advertising, marketing, merchandising, publicity, and commercial uses and ancillary uses thereof, without any further notice or payment to or permission needed from you (except where prohibited by law).

You also agree to waive any applicable moral rights as contained in the User Submissions for any of the proposed uses described above. Without limiting the foregoing, submission of a User Submission constitutes your agreement that Dagne Dover is permitted to display the User Submission online for public viewing and/or comment (whether on Dagne Dover’s Website or on third party web pages), to incorporate the User Submission in online and offline advertising, marketing, promotional, and/or other commercial materials, and to reproduce, adapt, and distribution the User Submission in all media, whether now known or later developed. However, Dagne Dover will have no obligation to post or use any User Submission(s).

By submitting a User Submission, you agree to release, hold harmless and indemnify on behalf of yourself and your successors, assigns and representatives, Dagne Dover and each of its respective officers, directors, and employees from and against any and all claims, suits, actions, demands, liabilities and damages of any kind whatsoever arising out of or in connection with the use of such User Submission, including, without limitation, any and all claims for copyright infringement, invasion of privacy, violation of the right of publicity or of moral rights, and/or defamation. Without limiting the foregoing, in no event will you be entitled to, and you waive any right to, enjoin, restrain, or interfere with use of the User Submission or Your Personal Content embodied in such Submission or the exploitation of any of Dagne Dover's rights as noted above.

You understand that Dagne Dover is relying upon your representations, grants of rights, waivers, and releases in permitting you to submit a User Submission. You acknowledge that you may not terminate or rescind the grants of rights and licenses and/or the releases contained in these Terms of Service.

Dagne Dover does not endorse any User Submission, or any opinion, recommendation, or advice expressed therein, and expressly disclaims any and all liability in connection with User Submissions. Dagne Dover reserves the right to remove any User Submissions without prior notice (or to refuse to publish any User Submission) for any reason, and to terminate or refuse a User's access to its Website for any reason.

Intellectual Property Rights

The Website and its entire contents, features, and functionality (including, but not limited to, all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Dagne Dover, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other applicable intellectual property or proprietary rights laws.

The Dagne Dover name, the Dagne Dover Emblem, and all related names, logos, product and service names, designs, and slogans are trademarks of Dagne Dover or its affiliates or licensors. You must not use such marks without the prior written permission of Dagne Dover. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

Dagne Dover is a provider of an interactive computer service for purposes of 47 U.S.C. section 230. As such, its liability for others' conduct and information is limited as described therein. Further, Dagne Dover is a service provider pursuant to the Digital Millennium Copyright Act. Pursuant to the Digital Millennium Copyright Act. If you are a copyright owner and believe that any content on Web Site infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA"). Dagne Dover Mobile Messaging Service Terms

The Dagne Dover mobile message service (the "Service") is operated by Dagne Dover. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”) and our Privacy Policy. By opting in to or participating the Service, you accept and agree to these Mobile Terms, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. These Mobile Terms are limited to the Service and are not intended to modify our Terms of Service, Privacy Policy, or any other agreement that may govern the relationship between you and us in other contexts. In the event of a conflict between the terms of these Mobile Terms and the Terms of Service, these Mobile Terms shall govern with respect to the Service.

We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for the Service in order to make any purchases, and your consent is not a condition of any purchase with Dagne Dover. Your participation in the Service is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

If you do not wish to continue participating in the Service, you may opt-out at any time. Text the single keyword command STOP to 59247 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Dagne Dover mobile message programs (to the extent such programs are offered) and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the Service with your new number.

The Service is oﬀered on an "as-is" basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage, or other changes made by your wireless carrier. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. Delivery of mobile messages is subject to eﬀective transmission from your wireless service provider/network operator and is outside of our control. Dispute Resolution. In the event that there is a dispute, claim, or controversy between you and us, or any other third-party service provider acting on our behalf to transmit the mobile messages within the scope of the Service, arising out of or relating to federal or state statutory claims, common law claims, these Mobile Terms, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of these Mobile Terms to arbitrate, such dispute, claim, or controversy will be, to the fullest extent permitted by law, determined by arbitration in New York, NY before one arbitrator.

The parties agree to submit the dispute to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in eﬀect. Except as otherwise provided herein, the arbitrator shall apply the substantive laws of the State of New York, without regard to its conﬂict of laws rules. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least ﬁve years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the AAA to appoint an arbitrator, who must satisfy the same experience requirement. In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties also agree that the AAA’s rules governing Emergency Measures of Protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be ﬁnal and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA. Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration; however, the arbitrator shall have the power to order one party to pay all or any portion of such fees as part of a well-reasoned decision. The parties agree that the arbitrator shall have the authority to award attorneys’ fees only to the extent expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration.

THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY VIA ARBITRATION AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ARBITRATION PROCEEDING.

Further, unless both parties agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Except as may be required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. If any term or provision of this section is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not aﬀect any other term or provision of this Section or invalidate or render unenforceable such term or provision in any other jurisdiction. If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial. This arbitration provision shall survive any cancellation or termination of your agreement to participate in the Service.

You warrant and represent to us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in these Mobile Terms or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Mobile Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Mobile Terms will otherwise remain in full force and effect and enforceable. Any new features, changes, updates, or improvements of the Program shall be subject to these Mobile Terms unless explicitly stated otherwise in writing. We reserve the right to change these Mobile Terms from time to time. Any updates to these Mobile Terms shall be communicated to you. You acknowledge your responsibility to review these Mobile Terms from time to time and to be aware of any such changes. By continuing to participate in the Program after any such changes, you accept these Mobile Terms, as modiﬁed.

Warranty Disclaimer and Limitation of Liability

IN NO EVENT SHALL DAGNE DOVER BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR OTHER LEGAL THEORY (I) FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING) OR (II) FOR ANY DIRECT DAMAGES IN EXCESS OF (IN THE AGGREGATE) $100. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.

You agree that the Web Site shall be deemed a passive service based solely based in New York and shall not give rise to personal jurisdiction over Dagne Dover, either specific or general, in jurisdictions other than New York, except as provided in the Privacy Policy. These Terms of Service shall be governed by the internal laws of the State of New York, without regard to its conflict of laws principles, except as provided in the Privacy Policy. Any claim or dispute between you and Dagne Dover that arises in whole or in part from the Web Site shall be subject to the exclusive jurisdiction of the federal and State courts located in New York, New York. These Terms of Service, together with the Privacy Policy and any other legal notices published by Dagne Dover on the Web Site, constitute the entire agreement between you and Dagne Dover concerning the Web Site. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and Dagne Dover's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NO CLAIM UNDER THESE TERMS OF SERVICE SHALL BE JOINED TO ANY OTHER CLAIM, INCLUDING ANY CLAIM INVOLVING ANY OTHER CURRENT OR FORMER USER OF THE WEB SITE, AND NO CLASS ACTION PROCEEDINGS SHALL BE PERMITTED. IN NO EVENT SHALL ANY CLAIM, ACTION OR PROCEEDING BY YOU BE INSTITUTED MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE.

Most communications between Dagne Dover and you will be sent and received electronically. You agree that all agreements, notices, disclosures, and other electronic communication exchanged between you and Dagne Dover shall satisfy any legal requirements that such communications be in writing.

Return Policy

Except with respect to final sale items or as otherwise described in this policy, you have 30 days from the date of the shipping confirmation for the corresponding product to return new, unused products for a refund. We are only able to issue refunds for Dagne Dover products purchased directly from our Website. If you purchased from another retailer, please contact that retailer directly for information on their return policy. Keep in mind that retail purchases may still be eligible for replacement or exchange in accordance with our Warranty Policies.

All US returns are subject to a $10 handling fee, which includes the cost of your return shipping to us. To start a return or exchange, please log into your account to submit a request. If you haven't set up an account, you can click here to fill out the request form. All you need is your order number and either the shipping zip code, phone number, or email address used at the time of purchase. If you don’t know your order number, you can locate this on your packing slip under “PO Number” or in your order confirmation email.

Discounts and promotions cannot be applied to exchange orders.

When your return has been authorized, you will receive a return merchandise authorization and US customers will receive a prepaid return label. We do not provide shipping labels for returns on international orders. If you are returning or exchanging an order placed to an address outside of the US, you will be required to cover the cost of postage for returns and exchanges. You bear the risk of loss during shipment. We strongly recommend that you fully insure your return shipment against loss and damage and that you use a carrier that can provide you with proof of delivery for your protection. No returns or exchanges will be accepted, and no refunds will be issued, without completing the above process to receive a return merchandise authorization.

If you are returning items from multiple orders, they must be shipped separately.

For exchanges or returns of products that are defective or were received damaged, please refer to the applicable Dagne Dover Warranty Policy related to your purchased product, available at: https://www.dagnedover.com/pages/warranty. In the event of any conflict or inconsistency between the terms of this Return Policy and our Warranty Policies, the Warranty Policies shall govern and control.

Items sent back to Dagne Dover without first requesting a return through the above process will not be accepted. Products marked as final sale items are not eligible for returns, exchanges, or refunds. Sales of gift cards are final sale and cannot be returned, exchanged, or refunded. If you have questions, contact Dagne Dover at support@dagnedover.com before making a final sale purchase.

Any return made on an order with a total value of $1,000 or more will be processed upon receipt and inspection at our return facility, not at the time of shipment or delivery. Dagne Dover reserves the right to inspect all items returned in connection with this policy, regardless of order value.

In the event Dagne Dover suspects fraud in its reasonable discretion in connection with your return or returns you have previously initiated with Dagne Dover (“Return Fraud”), Dagne Dover reserves the right to take any and all available remedies at law or in equity, including those described in this policy. If you have initiated one or more returns and Dagne Dover reasonably believes you have previously engaged in Return Fraud, Dagne Dover reserves the right to refuse any return request and return any items sent to us without refund on such items unless and until you have resolved the prior Return Fraud incident(s) in the manner reasonably instructed by Dagne Dover. Such instructions can include, but are not limited to, return of items related to such Return Fraud incident(s), remit to Dagne Dover amounts previously refunded in connection with such Return Fraud incident(s), or, if any amounts owed to you exceed the amounts of items reasonably determined by Dagne Dover to be related to unresolved Return Fraud incidents, to set off such amounts owed to Dagne Dover from such amounts owed to you. Dagne Dover reserves the right to permanently refuse to sell products through the Website to anyone who has engaged in Return Fraud or otherwise violates these Terms of Service.

When you submit a photograph in connection with Dagne Dover’s customer loyalty program, you retain your rights to your photograph. However, by submitting a photograph, you grant Dagne Dover (and those authorized by Dagne Dover) a royalty-free, worldwide, perpetual , non-exclusive, transferrable, and sublicensable license to publicly display, distribute, reproduce, and create derivative works of the submitted photograph, in whole or in part, in any media now in existence or later developed, for any purpose, including but not limited to, advertising and promotion of Dagne Dover, its website, social media pages, and commercial products. You also agree to irrevocably waive all right of integrity and any other rights to the photograph under Section 106A of the Copyright Act, commonly known as “moral rights,” and, to the extent this waiver is not permitted by applicable law, you agree not to enforce any such moral rights against Dagne Dover or any individual or entity it authorizes to receive copies of the photograph. Any photograph reproduced will include a credit to you and/or your social media username as feasible. Photographs distributed by Dagne Dover on social media may also grant the respective social media platform a license to use the photographs, as described in further detail in each platform’s respective terms of service.

You also grant us the right to use your name, image, likeness, biographical information (if provided), social media username (if provided), and any other information about you that you provide in connection with your submission of a photograph or the creation and maintenance of your customer loyalty account in connection with the photograph and any derivative works created of the photograph for any purpose, including but not limited to, advertising and promotion of Dagne Dover, its website, social media pages, and commercial products.

By submitting a photograph, you represent and warrant that you are at least eighteen (18) years of age and have the full right, power, and authority to enter into this agreement and grant the above license and rights. If the photograph incorporates any person other than yourself, you represent and warrant that you have obtained the permission of each represented person to submit the photograph and to grant the license, rights, and waivers described above on their behalf. You further represent and warrant to Dagne Dover that I will provide only true and correct statements and other information in connection with my submission (including but not limited to the fact that the Dagne Dover products depicted are my own and any opinions expressed about such Dagne Dover products are current, accurate, and truthful and made of your own free will), and that Dagne Dover and its licensee’s use of the photograph and the rights and licenses you grant do not, and will not, violate any intellectual property right (including, without limitation, copyright, trademark, right to privacy, or right of publicity) of, or conflict with or violate any contract with or commitment made to any person or entity and that no consent or authorization from, or any payment to, any third party is required in connection with the submitted photograph. You further agree to defend, indemnify, and hold harmless Dagne Dover and its licensees from and against all claims by third parties resulting from your breach or alleged breach of this agreement or any of these representations and warranties.

Dagne Dover will not be required to pay any additional consideration, royalty, payment, or other compensation or to seek any additional approval from you in connection with the license and rights granted or permitted uses described above.
